Terms of Use

These Terms of Service ("Terms") govern your use of https://get-aiw.com and participation in the pilot program offered by CopusLabs LLC, doing business as All Is Well ("All Is Well," "we," "us"). By using the website or joining the pilot, you agree to these Terms. If you do not agree, please do not use the website or join the pilot.

1. A pilot program

The All Is Well pilot is an early, invitation-only program. It is experimental. Features may change, be interrupted, or be discontinued, and we may limit, pause, or end the pilot or any household's participation at any time, with or without notice. Participation does not create any promise that a product or service will become commercially available.

2. Not a medical or emergency service

All Is Well is not a medical device, medical alert system, or emergency service, and it is not a substitute for emergency services. It does not monitor health, detect falls, or summon help. In an emergency, call 911. Do not rely on All Is Well for the safety or care of any person. It is meant only as a gentle, supplementary way for family members to stay in touch.

3. No guarantee of notifications

Notifications depend on many things outside our control, including home power, Wi-Fi and internet service, mobile carriers, and email providers. Messages may be delayed, not delivered, or sent in error. We do not guarantee that any check-in, alert, or notice will be sent, received, or accurate, or that the service will be uninterrupted or error-free.

4. Eligibility and agreement of the person being checked on

You must be at least 18 and able to enter into a binding agreement. By submitting an intake form you confirm that the person who would use the device knows about the pilot and agrees to take part (or that you will talk with them before installation), and that the information you provide is accurate. We only install a device with that person's agreement.

5. Pilot device

  • Any device we provide is loaned to the household for the pilot. It remains the property of CopusLabs LLC at all times. No ownership passes to you.
  • You will keep the device in normal home use, will not sell, modify, disassemble, or reverse-engineer it, and will not let it be used for any unlawful purpose.
  • You will return the device promptly on request, including when the pilot ends or the household leaves the pilot. We will arrange the return with you.
  • You are responsible for reasonable care of the device and for contacting us if it is lost, damaged, or not working. We may ask you to cover the cost of a device that is lost or damaged through misuse.
  • The device needs electricity and a working Wi-Fi connection that you provide.

6. Text messages and email

If you agree to receive alerts by text message, the SMS Terms apply. You can stop texts at any time by replying STOP. Our handling of personal information is described in our Privacy Policy.

7. Acceptable use

You agree not to:

  • provide false information, or enroll someone without their knowledge or agreement;
  • use the website or pilot to harass, monitor against their wishes, or harm any person;
  • submit another person's contact information without their permission;
  • interfere with or attempt to gain unauthorized access to our systems, or use bots, scrapers, or automated means to submit forms;
  • upload malicious code or overload our systems; or
  • violate any law or the rights of others.

We may suspend or end your access if you violate these Terms.

8. Fees

The pilot is offered without charge unless we tell you otherwise in writing before you join.

9. Intellectual property

The website, the device software, and all related content are owned by CopusLabs LLC or its licensors. We grant you a limited, revocable, non-transferable permission to use the website and the loaned device for the pilot as these Terms describe. You may give us feedback, and you agree that we may use it without obligation to you.

10. Disclaimer of warranties

The website and the pilot are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, CopusLabs LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from missed, delayed, or undelivered notifications or from reliance on the pilot, even if we have been told such damages are possible. Our total liability for any claim relating to the website or pilot will not exceed $100. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

12. Indemnity

You agree to defend and hold harmless CopusLabs LLC from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or the information you provide, to the extent permitted by law.

13. Ending participation

You may leave the pilot at any time by emailing us. We may end your participation at any time. When participation ends, you will return the device on request, and we will handle your data as described in the Privacy Policy.

14. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the effective date. Continued use of the website or pilot after a change means you accept the updated Terms. For significant changes affecting pilot households, we will also notify you by email.
